Terms of Use

In force as of 25 October 2026

1. Purpose of the Terms of Use & definitions

These Terms of Use (the “Terms”) govern access to and use of the EloTrades platform, available at https://elotrades.com (the “Service”). They set out the rights and obligations of users (each a “User”) and of the publisher, Hecatek SARL (SIREN 930741277), whose registered office is at 183 Chemin des Négadoux, 83140 Six-Fours-les-Plages, France (the “Publisher”).

The Service is offered to consumers and to professionals and is available in French, English and Spanish. These Terms are available in French, English and Spanish; each version is authoritative for the User who uses the Service in that language.

  • Service: all the features offered by EloTrades, including in particular the trading journal, the analysis tools, the charts, the backtesting module and the analytics dashboard.
  • User: any natural or legal person who accesses the Service, whether free of charge or for a fee.
  • Content: all data, information, text, images, screenshots, charts, simulated results and other items displayed, imported or generated through the Service.
  • Account: the personal space created by the User in order to access the features of the Service.

2. Acceptance of the Terms & amendments

Accessing and using the Service implies unreserved acceptance of these Terms. The Publisher may amend the Terms to reflect changes to the Service, to its service providers or to its legal obligations.

Any amendment is notified to Users holding an Account by email at least thirty (30) days before it takes effect, unless a faster change is required by law or by a decision of an authority. An amendment that adversely affects the User’s rights or the User’s conditions of access to and use of the Service applies only once the User has accepted it; a User who refuses it may, free of charge, terminate their subscription and delete their Account, and retains the previous terms until that date. Changes to the price and features of paid subscriptions are governed exclusively by the General Terms of Sale.

Updates to the Service itself (fixes, security, new features) may be made at any time; where an update has a negative impact on a consumer’s access to or use of the Service, the consumer is informed in advance and has the rights provided for in Article L.224-25-26 of the French Consumer Code.

3. Access to the Service / availability / maintenance / security

The Publisher endeavours to ensure normal access to the Service, without guaranteeing continuous, error-free or uninterrupted availability. Temporary suspensions may occur for maintenance, updates, security, technical changes or constraints related to a third-party provider.

The User undertakes not to impair the proper functioning, integrity or security of the Service, in particular through automated extraction, circumvention of technical protections, attempted unauthorised access, deliberate overloading or misuse of the features.

4. Accounts & authentication

Access to certain features requires the creation of an Account. The User undertakes to provide accurate, up-to-date and complete information. The User is responsible for the confidentiality of their login details and password and for any access made from their Account.

The User must inform the Publisher without delay of any unauthorised use of their Account or any breach of its security. The Publisher may suspend or restrict access to the Account in the event of a breach of these Terms, a security risk, non-payment or manifestly abusive use.

5. Rules of use & prohibited content

The User undertakes to use the Service in accordance with applicable laws and regulations, the rights of third parties and the purpose of the Service. In particular, it is prohibited to:

  • publish, import or disseminate content that is unlawful, defamatory, fraudulent, misleading, hateful, violent or that infringes privacy or the rights of third parties;
  • use the Service for fraudulent purposes, for manipulation, to undermine security or to circumvent technical or contractual limitations;
  • extract, reproduce, resell, redistribute or make available all or part of the Service, its charts, data, software or interfaces without prior written authorisation;
  • use the Service as infrastructure to develop a competing or derivative service from the components, charts or data accessible through the platform;
  • access the Service or extract its content by automated means (bots, scripts, site rippers, "scraping", agents or browsers driven by artificial intelligence, including from a logged-in session), with the exception of search engines and assistants that comply with the indexing rules published by the site;
  • reverse engineer, disassemble, decompile or attempt to reconstruct the source code, algorithms, API or databases of the Service;
  • systematically reproduce or imitate the interface, user journeys, text or presentation of the Service, including by means of artificial intelligence tools, with a view to creating a similar service.

6. Intellectual property

The Service as a whole, its architecture, software, interfaces, text, logos, databases, content, trade marks and graphic elements are protected by the applicable intellectual property rights.

Unless expressly provided otherwise, the User is granted a personal, limited, non-exclusive, non-assignable and non-transferable right to access and use the Service, solely for the purposes of normal use of the Service.

The graphic and software components embedded in the Service remain protected. The User acknowledges that they are prohibited from extracting, copying, reproducing, adapting, decompiling, separately reusing or redistributing them, in any form whatsoever.

As the producer of the Service's databases, Hecatek SARL benefits from the protection provided for in Articles L.341-1 et seq. of the French Intellectual Property Code: any extraction or reuse of a qualitatively or quantitatively substantial part of their content is prohibited.

In accordance with Article L.122-5-3 of the French Intellectual Property Code, Hecatek SARL expressly reserves its rights and objects to any text and data mining of the Service and its content, including for the training of artificial intelligence models, unless prior written authorisation is given.

Any breach of this article or of article 5 may result in the immediate suspension or deletion of the account, without prejudice to any legal action, in particular for infringement.

7. Personal data

The Publisher collects and processes personal data in accordance with the Privacy Policy available on the Service. The User is invited to consult it to find out the categories of data processed, the purposes, the recipients, transfers outside the European Union and the rights available to them.

8. Cookies & trackers

The Service uses cookies and trackers that are strictly necessary for its operation, as well as functional cookies relating in particular to authentication and to remembering the language. Details of the cookies used are set out in the Cookie Policy available on the Service.

9. Liability & reasonable limitation

The Publisher provides the Service with a reasonable level of care. Subject to the applicable mandatory provisions, the Publisher shall not be liable for indirect or non-material damage, or for damage resulting in particular from temporary unavailability, technical incompatibility, non-compliant use, the failure of a third-party provider or a misinterpretation of the information displayed on the platform.

The User remains solely responsible for their use of the Service, for the data they import into it, for the decisions they take on the basis of the results displayed and for keeping their login details safe.

10. Hyperlinks & third-party services

The Service may integrate or refer to third-party services, content, modules, data or websites. The Publisher has no control over these external resources and is not responsible for their availability, their content or their own contractual or technical terms.

10 bis. Market data and charts

The freemium model of the Service guarantees free access to the charts, subject to the functional limitations of the free plan.

The historical market data used in the backtesting module are provided by Dukascopy Bank SA. They are provided for information purposes only, reflect an independent assessment by Dukascopy Bank SA and constitute neither definitive market values at any given time, nor investment advice, nor an investment recommendation. The User is invited to consult the provider’s disclaimer: https://www.dukascopy.com/trading-tools/disclaimer.

10 ter. Economic calendar, analyses generated by artificial intelligence and no personalised investment advice

The Service offers an economic calendar and contextual analysis content generated automatically using standardised methods, published before and after the release of macroeconomic announcements (“pre/post-announcement analyses”). The analyses relating to a given event are published in identical terms to all Users viewing that event and do not, as such, take into account the personal situation of any particular User, including in particular their assets, financial situation, investment objectives, risk profile, portfolio or open positions.

More generally, the content, results, indicators, statistics and analyses published through the Service are provided exclusively for information purposes and as an aid to general analysis. They do not constitute a personalised recommendation relating to one or more transactions in financial instruments within the meaning of Article D.321-1 of the French Monetary and Financial Code, nor a portfolio management service on behalf of third parties, nor the reception and transmission of orders, nor the execution of orders on behalf of third parties.

Where certain modules of the Service (in particular the trading journal, the backtesting module or the analytics dashboard) use data entered by the User, the outputs produced result from automated and standardised processing applied to those data; they do not, in themselves, constitute a personalised recommendation based on a discretionary assessment of the User’s situation, even though what is displayed is specific to each User because of the data they have entered themselves.

Hecatek SARL declares that it is not registered as a Financial Investment Adviser (Conseiller en Investissements Financiers, CIF) within the meaning of Article L.541-1 of the French Monetary and Financial Code, and that it is not authorised as an Investment Services Provider (Prestataire de Services d’Investissement, PSI) within the meaning of Article L.531-1 of the same Code. The purpose of the Service is not to provide personalised investment advice within the meaning of Article D.321-1, nor to execute or arrange for the execution of transactions in financial instruments on behalf of Users.

The User remains solely responsible for their investment decisions. Financial markets carry a risk of capital loss, which may be total. If the User wishes to obtain advice suited to their personal situation, it is for them to consult a duly authorised professional.

Content generated by means of artificial intelligence systems or from third-party data may contain errors, approximations, biases or time lags, particularly in periods of high volatility or where incomplete data are supplied by third-party providers. Hecatek SARL does not guarantee their accuracy, completeness or suitability for an individual investment decision.

10 quater. Broker connections: MetaTrader 5 Expert Advisor and Topstep synchronisation

Purpose. The Service allows the User’s closed trades to be imported automatically by means of an Expert Advisor (the “EloTrades EA”) for the MetaTrader 5 platform, which can be downloaded from the Service settings, or by means of a synchronisation with Topstep. These features are optional: the User can always enter their trades manually.

Read-only operation. The EloTrades EA is limited to reading the history of closed positions on the trading account on which the User installs it, and to transmitting that information to the Service by means of a personal token. It does not open, modify or close any position and does not place any order. Sending the data requires the User to authorise the Service’s address themselves in the MetaTrader 5 options.

Licence. The EloTrades EA is software published by Hecatek SARL and protected by copyright. Hecatek SARL grants the User, for the lifetime of their account, a free, personal, non-exclusive and non-transferable licence to install and use the EA on their own trading accounts, solely for the purposes of using the Service. Except where expressly permitted by law, in particular Article L.122-6-1 of the French Intellectual Property Code, the User shall not sell, rent, distribute or make it available to third parties, modify it, decompile it or circumvent its operation.

Prior verification by the User. Some brokers, trader evaluation firms (“prop firms”) or funding programmes prohibit or restrict the use of any Expert Advisor, including one that places no orders. Before any installation, the User checks, for each of their accounts, that use of the EA is permitted under the terms applicable to them. Information on the rules of certain prop firms displayed in the Service is indicative and may not be up to date. Hecatek SARL cannot be held liable for the consequences of using the EA in breach of those terms, such as a refusal of payout or the closure of an account.

Availability of the import. The EA and the synchronisation are provided as is. Their operation depends on factors outside the Service, in particular the MetaTrader 5 platform, the broker, Topstep, the internet connection and whether the terminal is open. A trade closed while the terminal is closed, in sleep mode or disconnected may not be transmitted. It is for the User to check their journal and, where necessary, to add any missing trades manually.

Token and keys. The synchronisation token is personal and confidential; the Service stores it only in hashed form. The User may regenerate it or delete a connection at any time from the settings, in particular if they suspect it has been disclosed. The Topstep synchronisation requires API access offered by Topstep and its service provider, subscribed to and paid for by the User directly with them; the corresponding key remains stored in the User’s browser and is not transmitted to the Service’s servers.

End of use. Deleting a connection or the account renders the corresponding token unusable. The User then removes the EA from their MetaTrader 5 terminal.

11. Financial terms

The Service is based on a freemium model:

  • Free plan: access at no cost to certain features, with limitations on capacity, history, options or usage, as detailed in Article 3 of the General Terms of Sale; the News tab (economic calendar and AI analyses) is accessible during the 15 days following registration;
  • Paid plans: monthly or annual subscriptions (Starter, Growth and Elite plans) giving access to extended features depending on the plan chosen, under the conditions presented at the time of subscription.

Prices, included features, applicable taxes and payment terms are stated before the subscription is confirmed. Any price change applies for the future and, where applicable, from the next renewal date.

12. Termination / account deletion

The User may terminate their subscription or request the closure of their Account from their personal space, using the procedure provided on the Service. The subscription is terminated from the “My subscription” section of the settings; termination is confirmed to the User by email. Deletion of the Account, which is irreversible, is confirmed by typing the word “DELETE”; beforehand, the User may download all of their data in JSON format from the “Export my data” section.

Deletion of the Account ends the current paid subscription; the portion of the period already paid that has not yet elapsed is refunded pro rata to the remaining time, under the conditions of the General Terms of Sale. It also entails the erasure of the two-factor authentication data. It does not deprive a consumer User of their right of withdrawal (Article 8 of the General Terms of Sale). Invoices, credit notes and evidence that the Publisher is required by law to retain are kept under the conditions set out in the Privacy Policy.

Terminating the subscription without deleting the Account keeps access open until the end of the period already paid: unless otherwise stated at the time of the request, termination takes effect at the end of the current subscription period. No pro rata refund is therefore due for a monthly or annual period that has already begun, without prejudice to the right of withdrawal provided for in the General Terms of Sale. Deleting the Account, which ends access immediately, gives rise instead to the refund provided for in the previous paragraph.

The Publisher may suspend or delete an Account in the event of a breach of these Terms, unlawful use, a risk to the security of the Service, an infringement of the rights of third parties or non-payment.

12 bis. Sharing trading results

The Service allows the User to generate an image of a trade (instrument, result, statistics) and to share it on social networks. This image bears the statement: “Isolated result, neither representative nor guaranteed. Past performance is no guide to future performance. Risk of capital loss.” The User shall not remove or conceal it.

A User who publishes such an image states, where this is not obvious, whether it is a real trade or a simulated trade (backtest), and the period concerned. The User does not use it to promote an investment service, a broker, a financial product or a crypto-asset. If the User receives remuneration or a benefit for this publication, they comply with the rules applicable to commercial influencer activity, in particular the clear disclosure of the commercial intent (French Law No. 2023-451 of 9 June 2023).

Hecatek SARL does not republish images shared by Users without their prior written consent.

13. Evidence & archiving

Computer records, technical logs, electronic confirmations, connection logs and data kept by the Publisher constitute admissible evidence of the operations, communications and actions carried out on the Service, subject to the applicable mandatory provisions.

14. Governing law & jurisdiction

These Terms are governed by French law.

In the event of a dispute with a professional User, and failing an amicable settlement, exclusive jurisdiction is expressly conferred on the competent courts of Toulon, including in the case of multiple defendants or third-party proceedings for indemnity.

For consumer Users, the mandatory statutory rules on territorial jurisdiction continue to apply.
